Filtering/Lane Splitting rules.

So I am commuting to work on the 400 at the moment and I have to ride down a dual carriageway currently undergoing roadworks.

They have blocked off the left hand lane with cones just over the dividing line however they don't seem to be do any maintenance whatsoever, the lane is totally usable, presumably they are resurfacing sections overnight or something.

Anyways, my question is:

When filtering is it illegal to ride in the left hand lane? ergo on the wrong side of the cordoned off area, there are no workers on site and the road is perfectly usable.

The road is about 3 miles long with a bunch of traffic lights on it meaning the tailback is unbearable, about 30 minutes everyday just to go 3 miles....it's rather annoying XD
Those other gents in the tin boxes aren't very appreciative of me blowing past the traffic unfortunately and never move over :P

The roadworks are due to go on for the next 2 weeks, I am only asking because yesterday I got so annoyed with this berk in front braking like a child had stopped out in front of him every time the traffic moved away I used this lane and a member of the fuzz waved his finger in a condescending manner as I blew past :P

Any thoughts?

If the lane is blocked off then you must not enter it.
I have nipped in/out of the coned off area to get past a stationary car though.

The other thing about coned off areas is they are effectively building sites in my mind. So theres a chance all sorts of crap could be laying around ready to puncture your tyre or even diesel to slip on.

Have you thought about another route in to work?

I ended up taking the four mile detour west and through the Tyne Tunnel, saved the bother of traffic.

Patience is a virtue, one of which I do not possess. :smt009
